1. Who operates Qasha
These Terms govern your use of https://www.qasha.org.za and related services (the “Platform”), operated by QASHA DIGITAL (PTY) LTD trading as Qasha (“we”, “us”, “Qasha”). 2. Platform role — not your landlord
Qasha is an online marketplace that helps people list accommodation and connect with people who wish to rent. We are not the landlord, estate agent, or a party to your lease unless we say so in writing. Hosts and guests are responsible for their own rental agreements, compliance with South African rental and municipal laws, deposits held offline, and tax obligations.
3. One account
You register once as a Qasha user. You may browse, message, request bookings, and list property with the same account, subject to these Terms and our rules (for example, you cannot book your own listing). You must be at least 18 years old and provide accurate information.
4. Bookings
When you submit a booking request, the host may accept or decline. Acceptance does not by itself create a binding lease between Qasha and you — your rental relationship is with the host unless we state otherwise.
Always inspect a property and confirm terms (rent, deposit, utilities, lease length) with the host before you pay money or move in. Qasha does not guarantee the condition, safety, or legal status of any listing.
5. Payments on Qasha
Where Pay on Qasha is enabled for a listing, you may pay a securing amount through our payment partner Ozow (card or instant EFT). The payment provider’s own terms apply at checkout. We do not store your full card number or CVV on our servers.
- When you pay to secure a booking, the host is notified. If the host declines, we aim to refund your securing payment in line with these Terms and our payment partner’s processes.
- If the host accepts, the securing amount is handled as described at checkout and in messages on the Platform (including payout to the host’s nominated bank account where applicable).
- Optional paid services (for example featured listings, host verification badges, or account upgrades) are charged as shown before you pay. Fees are generally non-refundable once the service is delivered, except where the Consumer Protection Act, 2008 (“CPA”) requires otherwise or we agree in writing.
Booking deposits on Qasha are not available yet — arrange deposit and rent with the host in Messages. Paid featured listings and host verification will use our payment partner when checkout is live.
6. Cancellations & disputes
Cancellations after a host accepts, move-in issues, property condition, and offline payments are primarily between host and guest. Qasha may help with reports and may remove content or suspend accounts, but we do not guarantee outcomes unless required by law.
Chargebacks and payment disputes may be handled through our payment partner and card networks. We may share booking records needed to resolve a dispute.
7. Your content & listings
You keep ownership of photos, video, and text you upload. You grant Qasha a non-exclusive licence to host, display, and promote that content on the Platform. You warrant that you have the right to list the property and to use all media you upload (including any music in video tours).
Hosts must provide accurate information. Do not list property you do not own or manage without permission. We may remove content or suspend accounts that breach these Terms.
8. Conduct
Do not post false or damaging statements, harass others, commit fraud, list illegal property, discriminate unlawfully, or share contact details in listings to bypass the Platform. Messages and reviews must follow the same rules. You are responsible for what you publish.
9. Verification & badges
Optional paid badges (for example Verified Landlord) mean we reviewed documents you submitted — not a guarantee of safety, property condition, creditworthiness, or legal compliance. Listings are published by hosts; Qasha does not inspect every property unless we say so in writing.
10. Non-discrimination
Users must comply with applicable South African law, including the Constitution and equality legislation. Unlawful discrimination in listings or messages is prohibited.
11. Copyright & takedowns
If you believe content infringes your copyright, contact us via Help → Report a problem with the URL, your work, and proof of ownership. We may remove reported content while disputes are resolved.
12. Consumer Protection Act
South African consumer law may apply to some transactions on the Platform. Marketing must follow CPA and POPIA rules. Nothing here limits rights you cannot contract away under the CPA.
13. Indemnity
To the extent permitted by law, you agree to indemnify Qasha against claims arising from your listings, bookings, messages, or breach of these Terms (including copyright infringement or defamation you cause).
14. Limitation of liability
To the extent permitted by law, Qasha is not liable for disputes between users, property condition, offline payments, or losses from relying on user-generated content. Our liability is limited as allowed under South African law.
15. Governing law
These Terms are governed by the laws of the Republic of South Africa. Courts in South Africa have jurisdiction, subject to any mandatory consumer protections.
16. Changes
We may update these Terms. We will post the updated version on the Platform with a new “last updated” date. Continued use after reasonable notice means you accept the updated Terms where the law allows.
